it is not unlawful to drink alcohol & drive. Nor is it illegal for a pilot to drink alcohol and fly. It is against the law to operate under the INFLUENCE of alcohol. The government, either town, county, or State, tacitly endorses moderate drinking and driving. How? It requires restaurants and bars to obtain liquor licenses AND they must have parking areas sufficient for the patrons expected at those establishments
Drinking and driving is NOT illegal…only irresponsible. It is only illegal for “Drivers/Operators” of “Motor Vehicles”. A Motor Vehicle is defined under : U.S.C. Title 18 Part 1 Chapter 2 section 31. Only if you are engaged in commerce, then drinking and driving becomes illegal. But of course the Lawer (Liar) won’t tell you that.
If I go out and have a half a glass of wine with my dinner then decided to shoot pool for an hour then leave why is that considered the same to people as drinking and driving. You are not impaired nor have you broken any law but a lot of people this page included, believe that this is as wrong as drinking a six pack and barreling though an intersection. That term “Drinking and Driving” is very dangerous it profiles every single person under the same criteria. It’s about being responsible adults.

what is he talking about, if you refuse a breathalyzer test you will be automatically arrested for drunk driving, so you’re pretty much screwed either way

Okay, but if you refuse the roadside sobriety tests can’t you get arrested anyway for “suspicion” of being drunk? Then once you’re at the station you have to comply, right? Seems like the common man gets screwed no matter what

Well of course — how else did you expect police to arrest drunk drivers… If his advice really worked ( and you could simply refuse) then cops would never arrest anyone… if that really worked I would tell the cops to fuck off every time..

This guy is retarded. He obviously has never been pulled over by the police. The police officer do whatever they want to do to you and make up any bullshit to cover their ass. Including arresting ppl, beating them up, and shooting them. They have even been known to get away with rape and murder.

Where’s the cast that teaches us what to expect when you don’t “cooperate with the police? In the CDL world, an officer can strip-search your truck down to the last bolt and leave it to you to put it back together. They can rip your upholstry, destroy your load, and tear sheet metal in the process…just because you exercised your right to remain silent.

Police should be allowed to execute any drunk driver on the spot. That way, people will finally get it into their heads that drinking and driving is absolutely not acceptable.
Do not blow, do any test or give any information. Just give them your drivers license and insurance. Never blow. Do not drink and drive.

the Lawyer is giving a make believe version of corporate law, Not consitutional Law…you do not need a Drivers Licence too travel !
